A Transfer On Death (TOD) Deed is an estate planning tool in Indiana that allows a property owner to designate a beneficiary to inherit their real estate after they die.

It is important to know that a TOD Deed trumps anything else you have in place such as a Trust, Will, or any other estate planning legal document. Therefore, it can be an excellent tool to ensure that your property goes to the right person or people, but you have to keep it updated. Make sure you keep it with the rest of your estate plan and update it accordingly.

The cost of administration of your assets after death is substantially less because of the avoidance of the Court probate process.

How it works

The beneficiary automatically becomes the owner of the property when the current owner dies, without the need for probate court proceedings.

Who can be a beneficiary

A beneficiary can be an individual or an organization, such as a charity.

How to create a TOD deed

To create a valid TOD deed in Indiana, you must:

* Sign the deed and get your signature notarized

* Record the deed with the county recorders office in the county where the property is located before your death

* Pay a recording fee of $25

What the TOD deed does while you are alive

The TOD deed has no effect on the owners property rights while they are alive. The owner can still:

* Transfer the title

* Lease the property

* Add or remove beneficiaries

* Revoke the TOD deed
